Alimony is a court ordered payment from one
ex-spouse to another. Compared to determining child support, Georgia
law provides little specific guidance as to whether an alimony award
is appropriate and how much of an alimony award should be granted.
Because of the way an award of alimony (and the amount of alimony)
are determined, alimony awards are rarely overturned by Georgia’s
appellate courts making the decision of the trial court especially
meaningful in alimony cases.
In determining whether to grant alimony, a trial
court will generally determine whether an alimony award is
appropriate by looking at the needs of one party versus the ability
of the other party to pay. Several factors the court pays special
attention to are the parties:
- Position in society
- Manner and style of living
- Present earnings
- General financial condition,
including all assets such as real or personal property, stocks,
bonds, and other intangibles.
In addition to the above, the amount of
alimony is evaluated by looking to the following factors:
- Standard of living established during
the marriage
- Duration of the marriage
- The age, physical and emotional
condition of both parties compared to the financial resources of
each party
- Where applicable, the time necessary
to acquire sufficient education or training to enable a party to
find appropriate employment
- Contribution of each party to the
marriage, including, but not limited to services rendering in
homemaking, childcare, education, and career building of the
other spouse
- The condition of the parties,
including the estate of each party after the divorce and their
respective earning capacities and fixed liabilities
- Such other relevant factors as the
court deems equitable and proper
This summary is not a comprehensive list of
factors. It is important to note that the final alimony
determination will turn on the facts of each specific case. Since
there are not many explicit guidelines when determining the proper
amount of alimony payments to be awarded, it is up to the skill and
