Appeals in Divorce and Family Law Cases

Divorce Lawyers - Appeals, Child Support, Child Custody, Alimony, Family Law, Equitable Division, Contempt & Modifications in Atlanta & Georgia

If you are unhappy with the result of your divorce or family law case, it is important that you seek the assistance of attorneys that have experience in handling divorce appeals as soon as possible. Unlike other types of cases in Georgia, divorces and other family law matters operate under a different set of rules. Often, this means that any appeal you are seeking may be discretionary and that the Court of Appeals or Supreme Court of Georgia can deny hearing your matter altogether.

Because of the already complicated appellate process for divorces and family law matters in Georgia and the new Supreme Court pilot project, just deciding where to appeal and what is required to appeal can be extremely complicated. Depending upon circumstances, you may need to file your appeal with the Court of Appeals or you may need to bypass the Court of Appeals entirely and seek review directly from the Supreme Court of Georgia. In some cases, you must file an application for an appeal that is subject to review and approval by the appellate courts. In others, you must merely file a notice of appeal with the trial court. Regardless, it is your responsibility to make sure that the entire file is presented to the appropriate appellate court on appeal - including obtaining all necessary transcripts in a timely manner when available.

The divorce lawyers and family law attorneys at Meriwether & Tharp have experience with a number of divorce and family law appellate cases and can help other divorce attorneys and their clients with the proper procedure for how to file divorce cases and how to best present their arguments before the appropriate appellate courts. Remember, especially in these types of cases, time can be of the essence in protecting your rights and claims and the failure to act quickly can serve as a complete bar to your arguments ever being heard.

You can rely on Meriwether & Tharp to guide you through difficult divorce and family law situations. To speak to a member of our team, you can call our office or e-mail us to schedule an appointment to meet with someone on our family law team.
