A pre-marital agreement (also known as prenuptial or ante-nuptial agreement) allows a couple to establish a plan prior to marriage to avoid misunderstandings and later disagreements, especially regarding finances.  The attorneys at Meriwether & Tharp will effectively guide you through the process.

For couples who are remarrying, a pre-marital agreement is a practical solution for keeping debts, commitments and responsibilities for ex-spouses and children separate.  A good pre-marital agreement can also help in determining how assets will be distributed to children or other family members, in the event of a later divorce or death.

The pre-marital agreement will be enforceable only if signed with the willing consent of both parties to the marriage.  Both parties must be of sound mind or not be under duress.  Also, for the pre-nuptial to be valid, both parties must disclose all assets, property, and financial considerations to the other party.  Should one of the parties fail to disclose any specific assets or property he or she owns, and a divorce is filed, the person who failed to list or disclose those assets in the pre-marital agreement may be required to treat that property as marital property, subject to equitable division as part of a future divorce.
